Kris Humphries Likely to be Legal Father of Kim Kardashian and Kanye West's Baby, While Legal Woe Continues

Kanye West may have proudly announced Kim Kardashian's pregnancy last week, but the rapper father-to-be will have to make some efforts to claim his baby, or else Kim's estranged husband Kris Humphries may end up as the child's legal father.
While Kardashian filed for divorce from Humphries in October 2011, the NBA star has refused to settle. The 27-year-old basketball player is accusing Kardashian for using their 72-day marriage as a publicity stunt, and is demanding the reality start to confess her transgressions and return the $2 million Elaine Schwartz diamond engagement ring.
"Kris isn't trying to drag this out, but he wants to be vindicated in court. Kris will see this through to the end," an insider told RadarOnline.com.
According to California law, a man is presumed to be the natural father of a child if he is or has been married to the mother, CNN reports. He would be the presumed father of the newborn baby, though the paternity could be cleared with a "clear and convincing" evidence" like a DNA test, according to CNN.
"Unless Kim Kardashian gives in to Kris' demand that she admit the marriagefraudulent, the divorce proceedings will still be ongoing and she will still be legally married to him when she gives birth," a source close to the situation told Radar.
"Kim is refusing to cave to any of Kris' demands. She has moved on with her life, and she won't agree to an annulment on grounds that the marriage was fraudulent because it would cause catastrophic damage to her brand," the source said.
In order to accommodate Humphries' basketball schedule, the earliest possible trial date is mid June, after the Nets finishes its play-offs.
